To provide our SaaS services internationally, Praesto operates in two distinct legal capacities:

• Data Controller: For Restaurant owners who sign up for an account, we control your registration and profile data.
• Data Processor: For your End-Customers, we process their data solely to facilitate your restaurant's orders and deliveries. The Restaurant remains the Data Controller for its customers.

2.1 Information from Restaurant Users

When you register for a Praesto account, we collect:

• Full Name and Email Address
• Company Name and encrypted Password
• Usage metrics and performance data (via Posthog)

2.2 Information from End-Customers

When an order is placed through our platform, we process:

• Full Name and Email Address
• Phone Number
• Delivery Details (Street Address and City)

We use the collected data to:

• Manage restaurant accounts and provide business statistics
• Facilitate delivery orders between customers and restaurants
• Send transactional emails via Resend
• Improve sales features and platform performance via Posthog
• Handle subscriptions and billing via Polar.sh

We do not sell personal information to third parties. We share data only with:

• Restaurant Owners: End-customer delivery details are shared with the specific restaurant where the order was placed.
• Sub-processors: Essential partners including Polar.sh (Payments/Merchant of Record), Resend (Email), and Posthog (Analytics).
• Legal Requirements: When necessary to comply with law or protect the rights and safety of our users.

We implement reasonable administrative and technical safeguards. However, security safeguards are capable of circumvention.

YOU ACKNOWLEDGE THAT PRAESTO DOES NOT AND CANNOT GUARANTEE THAT YOUR PERSONAL INFORMATION WILL NOT BE ACCESSED BY UNAUTHORIZED PERSONS CAPABLE OF OVERCOMING OUR SAFEGUARDS.

Under GDPR and other international laws, you have the right to:

• Access & Correction: Update your profile or request a data export.
• Deletion: Request permanent removal of your account and associated data.
• Cookie Control: Manage tracking preferences via our cookie banner.

We retain your information for as long as your account is active. Upon account deletion, personal data is removed from our active databases. We may retain Anonymous Information (non-identifiable) for platform optimization and business analysis.
